Planning Board

The Planning Board is responsible for reviewing site plan applications for residential and commercial developments and subdivision applications. The Planning Board is assisted in its work by several consultants including an engineer, an attorney, a planner, and the Village’s Code Enforcement Officers.

The planning board meets the 2nd Tuesday of each month at 6:00 PM.  Applications must be submitted to the Village Clerk no later than 4:30 PM either in person or via Postal Service with the applicable fees and escrow two weeks before the meeting date, along with a PDF of all submitted information to the Village Clerk’s email at clerk@villageofmonticello.com

Legal notices are published in the Sullivan County Democrat. Applications must be delivered by 9:00 AM on the deadline date, with no exceptions.

Zoning Board of Appeals

The Zoning Board of Appeals is responsible for approval of interpretation of the Village Zoning Law and hears applications for variances. The Board acts in a quasi-judicial capacity. It will give notice and hear evidence of the need for a variance. The law fixes certain criteria that the board must consider before it can grant a variance.

Criteria to enable granting a variance:

  1. That there are unique physical circumstances or conditions peculiar to the particular property and that the unnecessary hardship is due to such conditions and not the circumstances or conditions generally created by the provisions of the zoning ordinance.
  2. That, because of such physical circumstances or conditions, there is no possibility that the property can be developed in conformity with the provisions of the zoning ordinance and that the authorization of a variance is, therefore, necessary to enable the reasonable use of the property.
  3. That such unnecessary hardship has not been created by the appellant.
  4. That the variance, if authorized, will not alter the essential character of the neighborhood or district in which the property is located, nor substantially or permanently impair the appropriate use or development of adjacent property, nor be detrimental to the public welfare.
  5. That the variance, if authorized, will represent the minimum variance that will afford relief and will represent the least modification possible of the regulation in issue.

The Zoning Board meets as necessary on the 3rd Thursday of the month at 6:00 PM.  Applications must be submitted to the Village Clerk no later than 4:30 PM either in person or via postal service with the applicable fees and escrow. Once hard copies of the application and necessary documentation is received along with a PDF of all submitted information to the Village Clerk’s email at clerk@villageofmonticello.com a meeting will be setup and the applicant will be notified of the meeting date.
